TERMS AND CONDITIONS

Please read our Terms and Conditions (“the Terms”) carefully before signing up for membership. By signing at the end of this document you are confirming that you have read the Terms and agree to be bound by them. These Terms together with the items listed in paragraph two, below, constitute a membership contract between you (“the client”) and us (“Studio One Islington Limited”).


1. INTRODUCTION

All classes, courses and workshops are supplied by Studio One Islington Limited, trading as Studio One Islington Limited, company number 09640760, registered office Flat 1, 135 Grosvenor Avenue, London, N5 2NH, All Rights Reserved.

Throughout these Terms, “we”/”us”/”our” refers to Studio One Islington Limited. And “you”/”your”/”yours” refers to the client.


2. BOOKING CLASSES

The cost of each class/course/workshop will be shown clearly on the online timetable in accordance with your particular profile: Pay-As-You-Go; Studio One card holders; or members.

As a member, all classes/workshops included in your chosen membership package will have no cost attributed to them. Any additional classes/workshops/courses offered outside of the membership must be paid for at the time of booking.

Bookings for classes can be made up to 14 days in advance.

Bookings can be made via the online timetable on the website, via email (info@studioone.co) , over the phone, or in person at our premises. It is your responsibility to ensure that you have made your booking and submitted payment correctly.


3. PAYMENT FOR PAY-AS-YOU-GO (DROP-IN)

If you wish to pay for additional classes/workshops/courses/promotions in addition to your membership via the pay-as-you-go option:

Payment for your class/course/workshop may be made by cash, credit card or debit card. Payments can be made online, over the phone or in person on the premises.


4. RETREATS/EVENTS

All payments for retreats or events is none refundable. 


5. CANCELLING YOUR BOOKING, LATE CANCELLATIONS AND NO SHOWS

You may cancel your booking, without charge, up to 12 hours before the start of the session that you have booked. If you book onto a session within 12 hours of its scheduled start time, there is no entitlement to cancel other than in accordance with the next paragraph.

As part of your membership, you are allowed 5 late cancellations (within 12 hours of scheduled start time) or no-shows per calendar month. Any additional late cancellations or no-shows will be charged at the Studio One Top Up Card rate per session . These resulting additional charges will be made at the beginning of the following month.


6. MAKING A CHANGE TO YOUR BOOKING

You may change your booking for a class, without charge up to 12 hours before the start of your class/course/workshop that you have booked.

You may change or cancel a class booking online, by phone, e-mail, or in person at the premises.


7. IF WE CANCEL YOUR BOOKING

In the event that we cancel a class or classes that you have booked, we will contact you by email or telephone to let you know. At the time of cancellation we will offer you the choice between:

1. having your Studio One Card re-credited with the price of the cancelled class; or
2. being transferred to a class at an alternative date and time.


8. BOOKING CONFIRMATION

Your booking is not complete until you have received a booking confirmation from us. Please make sure you receive a booking confirmation before you attend the class. If you do not receive confirmation, please contact us by phone, e-mail, or in person through the receptionist on duty. Prices are subject to change at any time before we accept your booking.


9. LATENESS POLICY

Studio One operates a policy which prevents you taking part in a class if you are more than 10 minutes late. This policy is in place to prevent injury and to be mindful of the teacher and other participants in the class.


10. COMPENSATION

We will compensate you for any loss or damage you may suffer as a result of a breach of the duties imposed on us by law. However, our liability to you may be mitigated to the extent the loss or damage is attributed to:

1. your own fault;

2. a third party unconnected with the provision of our services; or

3. events which we could not have foreseen or avoided even if we had taken all reasonable precautions.

Our liability to compensate you (other than in the case of personal injury or death) will be limited to a reasonable amount having regard to such factors as whether the loss or damage was due to a negligent act or omission by us.


11. MEMBERSHIP FEE CHANGES

Studio One reserves the right to review and change membership fees periodically. Your monthly membership fees will remain the same as at your membership start date throughout your contracted period. Once your contract period has come to an end the membership fee will be charged at the rate at the time of the renewal.


12. WHAT’S INCLUDED IN A HALF MEMBERSHIP

All regular yoga classes, along with a range of fitness classes. The half membership excludes Reformer Pilates. No courses are included.


13. WHAT’S INCLUDED IN A FULL MEMBERSHIP

All standard classes are included. No courses are included.


14. PAYMENT

Payment may be made by cash, credit or debit card, if paid upfront, or monthly by direct debit. If paying by direct debit, you must pay the pro-rata amount for your first month’s membership upfront by cash, debit card or credit card. The direct debit form must be filled in and handed in with your membership form for Studio One to set up to start the following month.

Membership fees will be due each month of your contract period. The direct debits will always come out of your bank account on the 1st of the month. 


15. WHAT’S INCLUDED IN A ONE MEMBERSHIP

One Memberships offer access to one discipline only.  A discipline is defined as one style of classes ie Pilates, Yoga, Fitness.  The membership offers a limited number of classes a month for use within that discipline.  This is subject to availability. 


16. NON-PAYMENT OF MEMBERSHIP FEES

If your Membership fees become overdue, we reserve the right to refuse you entry into our studio/classes/courses/workshops until the overdue sums are paid in full.

Should you default on payments to us, we reserve the right to notify the default to a credit reference agency or other third party to obtain payment from you.


17. CANCELLATION OF MEMBERSHIP

All memberships last for a minimum of three months. After this time the direct debit payments will continue until you give notice of termination.

In order to terminate your membership, you must give us 30 days notice via e-mail to info@studioone.co.  This will indicate the time when no further membership payments will be taken.  No pro-rata payments or refunded for part used months will be permitted.

If you wish the membership to terminate after three months, you must notify us 30 days before the end of this period to ensure that no further direct debits are taken from your bank account.


18. MEMBERSHIP CARD

Each member will be issued a Studio One membership card that must be shown at reception upon each visit.


19. HOW YOU SHOULD CONTACT US

Any written notice or completed form (e.g. request to freeze membership) should be posted, faxed, e-mailed or given in person to the receptionist on duty at the studio.

You may change or cancel a class booking by phone, email, or in person at the studio.


20. FORCE MAJEURE

We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms, if the delay was due to any cause beyond reasonable control, including, but not limited to, acts of God, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T. viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.


21. WAIVER

No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing.


22. SEVERABILITY

If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.


23. ENTIRE AGREEMENT

These Terms together with our membership form and pre-activity questionnaire constitute the entire agreement between the parties and shall have effect to the exclusion of any other memorandum, agreement or understanding of any kind, whether oral or written, between parties.


24. GOVERNING LAW AND JURISDICTION 

These Terms shall be governed by and construed in accordance with English law and the parties hereby agree to submit the exclusive jurisdiction of the English courts.


25. REFERRALS

When making a referral members will be entitled to a free class should the referral buy a Studio One Membership.  

When referring an organisation the referrer will be  entitled to a free Studio One Membership Card worth £50 should the organisation arrange a corporate membership package.

All referrals must be in writing to the studio via email info@studioone.co


26. PERSONAL TRAINING

Introductory Sessions: Notice of cancellation must be made 24 hours in advance of the start time of the session. Failure to do so will incur a cancellation fee of the full cost of that session and loss of that session. All payments are non-refundable. Sessions must be used within 6 months of payment. Sessions not used within this time due to inactivity will be deemed void and non-refundable unless otherwise agreed between us.

 

PT Session: Sessions cannot be confirmed unless payment is made at least 24 hours in advance of the session. Notice of cancellation must be made 24 hours in advance of the start time of the session. Failure to do so will incur a cancellation fee of the full cost of that session and loss of that session.  All payments are non-refundable. Sessions must be used within 6 months of payment. Sessions not used within this time due to inactivity will be deemed void and non-refundable unless otherwise agreed between us.
